Certified Nurse Assistant or CNA Workers Comp Causation

by | Jan 17, 2016 | Workers Comp |

Certified nurse assistant or CNA workers comp causation in Wisconsin concerns low back disability and neck injury.  CNA jobs are essential to our society and economy because certified nurse assistants provide the care to our elderly parents and grandparents as well as our disabled brothers and sisters.  CNA work is difficult in every way and CNAs deserve our respect, admiration and compassion.  When a CNA gets hurt at work, they should get workers compensation not a cold shoulder denial.

Certified nurse assistants job duties and responsibilities include:

Personal Hygiene – bathing and washing patients as well as helping them shower.  Grooming and getting dressed, in short many activities of daily living.

Infection Control – following safety protocols in controlling the spread of germs, including washing your hands, soiled linens and patient clothing as necessary.

Dietary Care – serving meals

Administering Treatments – handle medical equipment you to include bladder scanners, intermittent pneumatic compression devices, anti-embolism stockings, bedpans and patient massage.  All include patient transfers, which are a leading cause of low back disc injury in certified nurse assistants.

The CNA physical demands are often categorized as medium by employers and insurance companies, however, since patients may be heavier and unable to assist in their own movements, the actual classification is heavy.

Assisting with patient transfers involves frequent lifting of over 100 lbs. with or without a Hoyer lift.  Patient transfers require frequent bending, twisting and turning at the waist.  Cleaning and bathing a patient involves frequent overhead and outstretched use of arms and neck flexion and extension.  Certified nurse assistants involve constant walking, squatting and crouching.  Heavy effort means Exerting 50 to 100 pounds of force occasionally, and/or 20 to 50 pounds of force frequently, and/or 10 to 20 pounds of force constantly to move objects. Exerting in excess of 100 pounds of force occasionally, and/or in excess of 50 pounds of force frequently, and/or in excess of 20 pounds of force constantly to move objects.

At McCormick Law Office in Milwaukee, Wisconsin our attorneys have proved that CNA job duties cause cervical and lumbar herniated discs.  Certified nurse assistants with neck or lumbar injuries often have cervical or lumbar fusion surgery.  If the CNA or certified nurse assistant has work-related permanent restrictions from the surgeon or doctor that prevent a return to work, there may be loss of earning capacity or vocational retraining workers compensation benefits available to the injured worker.  McCormick Law attorneys are experienced in winning successful CNA workers comp settlements based on honest and trustworthy expert opinions from treating surgeons and rehabilitation doctors, called physiatrists or doctors of physical medicine and rehabilitation who are board certified.  Certified nurse assistants deserve the full workers compensation by law.
